Terms of use & orders

A few clear terms.

What to expect when you share your scans and ask us to make something personal.

Draft for review · 21 October 2026. These proposed terms are not yet in force. Accounts and private uploads are available; payments are not open. The purchase sections below describe the proposed terms for future paid orders.

1. Who we are

baby.photo is operated by baby.photo LLC, Příčná 668/1, 110 00 Prague, Czech Republic. In these terms, “we” means the operator and “you” means the person using the service. Contact us at hello@baby.photo.

These terms cover the website, accounts, scan submissions and personal keepsake orders. An upload or saved draft does not create a paid order, require you to buy anything or guarantee that a keepsake can be made.

2. An artistic keepsake

We use ultrasound images, reference clips and suitable scan exports to create a personal artistic interpretation as a physical sculpture or digital model. The result depends on the information visible in your files. Hidden, incomplete or unclear areas may need interpretation, smoothing or reconstruction.

A keepsake is not a medical model, diagnostic assessment or reliable prediction of your baby’s appearance. Do not use it to make healthcare decisions. Examples on the site show what has been achieved with particular source files; they do not promise an identical result from every scan.

Physical sizes are measured from base to crown. Photographs and screens can affect how colours, textures and scale appear. These limitations do not remove our responsibility to supply the agreed product with the quality and characteristics we describe.

Physical keepsakes are decorative objects for adult display, not toys, teethers or objects for a baby’s cot. Handle them carefully and keep them out of children’s reach.

3. Your account

The account and ordering service is intended for adults aged 18 or over. Use an email address you control, provide accurate order details and keep access to your email and sign-in links secure. Tell us promptly if you think someone has accessed your account without permission.

You can contact us to close your account. Closing an account, withdrawing scan consent and cancelling a purchase are different requests; we will explain how each affects an open order and any records we must retain.

4. Sharing your scans

Submit only files you are entitled to share and have processed for this purpose. If they contain another person’s health information, obtain that person’s permission or other necessary authority. Buying a gift does not by itself give you permission to upload someone else’s scans. Remove unnecessary clinic labels and personal details where possible.

We ask separately for explicit consent to process sensitive information in your scans. Agreeing to these terms does not replace that consent, and consent to make a keepsake does not permit advertising, public gallery use or model training.

The form explains supported file types and limits. MRB, ZIP and other accepted containers are accepted for review; a successful upload, or a scanner’s “3D”, “4D” or “5D” label, does not establish that the file contains usable geometry. A photograph or video may provide a reference without containing a reconstructable volume.

Keep your own originals. Do not submit malicious code, unrelated personal information or content you have no right to use. We may reject unsafe, inaccessible or unsuitable files and explain what alternative information is needed.

You retain any rights you have in your source files. You give us limited permission to store, inspect, adapt and reproduce them as needed to review your request, make and deliver your keepsake, provide support and meet legal obligations. People and service providers assisting us may use them only for those purposes under appropriate arrangements. This is not a transfer of ownership or a general licence to reuse your scans.

5. Orders and payment

Payments are currently closed. The following purchase arrangements apply only when paid ordering is available. Saving scans today does not reserve a price or production slot.

Before you commit to a purchase, we will show the selected product, included digital files, total price including applicable taxes, delivery charges, available destination, expected delivery period and relevant digital compatibility information. Any additional work or charge needs your agreement. A physical order includes a digital model only when that option is included in the order.

Submitting a paid order is your request to buy the selected keepsake. A purchase is accepted when we send you an explicit acceptance email with the agreed details and a copy of the applicable terms. An upload confirmation or payment-provider receipt alone is not that acceptance. Payment may be collected before our scan review; payment itself does not confirm that the scans are suitable. We will state the review and acceptance timeframe before you pay. If we have not accepted by that deadline, you may cancel for a full refund.

If we cannot accept the order or cannot make the agreed keepsake from your scans, we will offer the chance to provide suitable replacement files or cancel and receive a full refund of the amount paid for that order, including any delivery charge. You do not have to accept a substitute product, store credit or additional charge. Refunds under this section are made without undue delay and within 14 days of rejection or cancellation, using the original payment method unless you agree otherwise.

We will confirm any change to the agreed specification or timing with you. A design proof or a particular number of revisions is included only if expressly offered in your order; this does not limit correction of defects or work that does not match what was agreed.

6. Receiving your keepsake

For a physical keepsake, we will agree a delivery period before purchase. Please check your delivery details and tell us promptly about a mistake. Where we arrange the carrier, we remain responsible for the goods until you or your nominated recipient receives them. Your rights if delivery is late, missing or damaged remain unaffected.

Digital files are released in your account after the agreed work is completed and payment is confirmed. We will identify the supplied format and relevant software requirements before purchase. We do not promise that every order includes every format, or that a file works with every printer or program.

Subject to any rights belonging to others, a purchased digital model comes with permission for personal, non-commercial use: keeping backups, displaying and sharing images of your keepsake, and making prints for yourself or as private gifts. You may give the file to a printing service solely to make those prints for you. Commercial reproduction or distribution of the model file requires a separate written agreement. This does not restrict rights you already hold in your original scans or rights the law gives you.

7. Changing your mind

Contact hello@baby.photo with your order reference as soon as you want to cancel or change an order. As an additional policy, we offer a full refund if you cancel before we begin modelling or physical production. Initial scan suitability review does not count as starting that work. We will notify you by email when modelling or production begins. After that, contact us to discuss what is still possible; your statutory rights always remain. Refunds under this additional policy are made within 14 days of cancellation using the original payment method unless you agree otherwise.

Personalised physical goods. A sculpture made from your scans is made to your specifications. The usual 14-day change-of-mind withdrawal right generally does not apply to such personalised goods. This exception does not remove rights relating to faulty, misdescribed or undelivered products.

Digital content. A personalised digital model is not automatically covered by the physical-goods exception. Where the statutory withdrawal right applies, it normally runs for 14 days from the contract. We will rely on its loss through early digital supply only after obtaining your separate express consent, your acknowledgement of losing that right when supply begins, and providing the required confirmation. General acceptance of these terms or scan-processing consent is not enough. Where those requirements are not met, your withdrawal rights remain.

To exercise an applicable withdrawal right, send us a clear statement identifying you and the order, for example: “I withdraw from my contract for [product], ordered on [date], order reference [reference], name [name], address [address].” This wording is optional. Where withdrawal entitles you to a refund, we will make it within the legally required period, normally within 14 days of your notice, using the original payment method unless you agree otherwise, without a refund fee.

Optional model withdrawal form

Complete and send this form only if you wish to withdraw from an eligible contract. Delete wording that does not apply.

Name of consumer(s): [name].
Address of consumer(s): [address].

8. If something is wrong

Email hello@baby.photo with your order reference and a description of the problem. Photos of damage or an error message can help, but please do not send additional sensitive scan data by ordinary email unless we have arranged a suitable way to receive it. We will explain the next steps and any return arrangements.

Your statutory rights apply if goods or digital content are faulty, missing or not as described. Depending on the circumstances, you may be entitled to repair or replacement, correction of digital content, a price reduction or termination and a refund. Any remedy required by law is provided without charge. The personal nature of a keepsake does not exclude these rights.

For EU consumer purchases, the legal guarantee for goods is at least two years from delivery; applicable law may provide more protection. One-off digital content also has statutory conformity protection. We handle complaints within the deadlines that apply to the particular product and customer.

The download and file-retention periods below do not limit your statutory rights. You do not lose a valid complaint because you discover a problem after 30 days. Normal artistic interpretation is not a reason to refuse a remedy when the result fails to meet the agreed description.

9. Privacy and file availability

Our privacy notice explains how we use personal information, who handles it and how to request access, correction, export, deletion or withdrawal of consent. Uploaded scans use private EU storage; this does not mean every provider or processing step operates exclusively within the EU.

Unpaid drafts and their files are scheduled for deletion seven days after the draft is created. Files for a paid order are kept while the order is being fulfilled. The normal retention period then ends 30 days after confirmed delivery for physical orders, or 30 days after model release for digital-only orders, whether or not a file has been downloaded. A documented, limited extension may be needed to resolve an open issue.

Download and keep your included digital files before access expires. The service is not a permanent archive. Deletion from live storage, expiry of restricted backups and removal of production copies are separate processes, described in the privacy notice. Required financial records are kept separately from scans.

You may withdraw consent for future scan processing by contacting us. We will stop the processing that depends on that consent and explain its effect on any unfinished work, remaining lawful retention and cancellation or refund rights. Withdrawal does not make earlier lawful processing unlawful and does not itself waive consumer rights.

10. Using the service fairly

Do not access another person’s account or files, interfere with the service, bypass access controls or use it for unlawful activity. If reasonably necessary to address misuse, a security issue or a legal requirement, we may restrict access while we investigate. We will explain the reason and offer a way to contact us where lawful and practicable. A restriction does not automatically forfeit a payment or remove your rights concerning an existing order.

We take reasonable care in providing the service. Temporary maintenance or an external service failure may affect availability; if it affects an order, we will explain the practical impact. These terms do not exclude liability or remedies that cannot lawfully be excluded, including applicable consumer and data-protection rights.

We may update these terms for future use of the service and will identify the new version and date. Changes do not retrospectively alter an accepted order or expand the permissions you gave us for an earlier scan submission. Where a change needs fresh agreement or consent, we will ask for it.

11. Contact and disputes

Please contact hello@baby.photo first so we can try to resolve a concern. Eligible unresolved consumer disputes may be submitted to the Czech Trade Inspection Authority’s alternative dispute resolution service. This does not prevent you from using another remedy or a court available under applicable law.

Nothing in these terms takes away mandatory protections that apply to you as a consumer, including protections of your country of residence where applicable. We do not require you to bring every dispute exclusively in Prague or submit to private arbitration.
